NO REFUNDS UNDER ANY CIRCUMSTANCES EVEN IF THERE IS A DELAY IN DELIVERY
1. Operating Conditions**: It is the strict policy of The Conex Guys, LLC that we do not operate in rain, snowing, high wind, thunderstorms, hail and or any adverse weather conditions that deem the safety of our drivers The safety of our drivers, as well as the security of the common carrier product being transported, is our top priority. Under no circumstances will we put our drivers or the cargo at risk.
2. **No Refunds After Payment**: Our policy, which has been clearly stated, is that no refunds will be issued once payment has been rendered. This policy is non-negotiable and has been communicated to all customers prior to their payment being accepted.
3. **Delivery Delays**: Any delays in delivery caused by the customer do not constitute a failure on the part of The Conex Guys, LLC to comply with our delivery obligations. The customer’s actions, including repeated delays and excuses, have been documented as part of a pattern of behavior that has resulted in the ongoing delay of delivery. Despite these delays, it is important to note that The Conex Guys, LLC remains committed to fulfilling our contractual obligations.
4. **Payments**: All payments are made via credit card and a 2.99% credit card processing fee is added.
5. **Delivery Timeframe**: All Deliveries are within 25-45 business days (but can be sooner but not guarantee) from payment. Unless specified section 3
6. **Delivery fee**: Delivery is Calculated from the port where the container will be picked from to the delivery address at a rate of $5.50 per mile
7. **Placement fee**: If a customer requests that the container be placed in a specific area there is be a $150.00 fee for the placement per hour. If a crane or a forklift is needed for placement the customer will be responsible 100% of the fee for such equipment.
8. *Delivery Vehicle Recovery Fee**: If under any circumstances the delivery vehicle and trailer is stuck in the mud, snow etc. and a recovery vehicle is called to remove the vehicle and recover the customer will be held responsible and liable 100% and the customer will pay the cost to the recovery company directly. The customer will pay for the lodging and all expenses ie: food and loss of use of the vehicle which is being recovered for the full duration of the recovery. The customer will also pay a $1,000.00 daily fee directly to The Conex Guys LLC for the loss of business.
9.**Taxation**: Tax is calculated at the local rate of the delivery address.
10.**Not Liable**: The Conex Guys, LLC and its delivery affiliates are not liable for ANY property damage on or off customers property.
11. If customer is invoiced and customer does not take delivery of Conex a dry run delivery fee will be charged in the amount of $2,500.00 if customer fails to pay this fee collection action will be taken and additional court cost and legal fees will apply plus any interest at 10%
12. if customer fails to pay on invoice within 24 hours of services being completed a 10% compound interest fee will apply and cost fees and legal fees
13. if customer chargeback a purchase for any reason a penalty fee of $2,500.00 per occurrence will apply plus court fees and legal fees
