By submitting payment, signing an invoice, accepting delivery, placing an order, or otherwise conducting business with The Conex Guys LLC, Customer acknowledges receipt of and agrees to these Terms and Conditions in their entirety.
1. NO REFUNDS
ALL SALES ARE FINAL.
NO REFUNDS SHALL BE ISSUED AFTER PAYMENT HAS BEEN RECEIVED. NO EXCEPTIONS.
Customer acknowledges that all deposits, payments, and purchases are non-refundable.
2. ADVERSE WEATHER POLICY
The Conex Guys LLC shall not operate, transport, or deliver containers during adverse weather conditions including, but not limited to:
- Snow
- Ice
- Thunderstorms
- High winds
- Crosswinds
- Chain controls
- Flooding
- Mudslides
- Wildfires
- Road closures
- Unsafe roadway conditions
- Any condition deemed unsafe by the Company or its drivers
The Company’s determination regarding weather and road safety shall be final.
Customer acknowledges that safety of personnel, equipment, cargo, and the public takes precedence over all delivery schedules.
3. MECHANICAL BREAKDOWNS AND EQUIPMENT FAILURES
Customer acknowledges that delivery schedules may be delayed due to mechanical failures, equipment breakdowns, repairs, maintenance requirements, accidents, tire failures, engine failures, transmission failures, hydraulic failures, trailer failures, towing equipment failures, or any other unforeseen mechanical issue involving transportation equipment utilized by The Conex Guys LLC or its transportation partners.
Any such event shall automatically extend the estimated delivery timeframe without penalty or liability to The Conex Guys LLC.
4. REFUSAL OF DELIVERY
If Customer refuses delivery, fails to accept delivery, is unavailable for delivery, fails to provide proper site access, or otherwise prevents completion of delivery, Customer agrees to pay a $2,500.00 cancellation and dry-run fee.
Customer shall remain responsible for all transportation costs, storage costs, legal costs, collection costs, and any additional expenses incurred by The Conex Guys LLC.
5. PORT OF OAKLAND CONTAINER DISCLOSURE
Customer acknowledges and understands that all containers sold by The Conex Guys LLC originate from and are stored at the Port of Oakland, California.
The Conex Guys LLC does not maintain a local container depot, inventory yard, or storage facility within the State of Nevada.
Customer understands that shipping containers are tangible goods transported in interstate commerce and are hauled from the Port of Oakland, California, to the final delivery destination.
The approximate transportation distance from the Port of Oakland to Reno, Nevada, is approximately 300 miles, with additional mileage depending on the final delivery location.
Customer acknowledges that transportation logistics, interstate transportation regulations, Department of Transportation compliance requirements, port operations, road conditions, traffic conditions, weather events, mechanical failures, labor shortages, government inspections, and circumstances beyond the Company’s control may affect delivery schedules.
By submitting payment, Customer acknowledges that the purchased container originates from the Port of Oakland and is not being delivered from a local Nevada container depot.
6. WINTER DELIVERY SCHEDULE
Winter delivery season shall run from November 1 through May 31.
Estimated delivery time is twenty-five (25) to forty-five (45) business days.
The following shall not count toward delivery time:
- Adverse weather delays
- Mechanical breakdowns
- Road closures
- Government restrictions
- Port delays
- Customer-caused delays
- Litigation or dispute delays
- Labor shortages
- Equipment availability issues
- Acts of God
- The Company’s fourth-week monthly business closure
- Weekends and holidays
Any such delay shall automatically extend delivery schedules.
7. SUMMER DELIVERY SCHEDULE
Summer delivery season shall run from June 1 through September 30.
Estimated delivery time is seven (7) to fourteen (14) business days.
All exclusions listed under Section 6 shall apply and may extend delivery schedules.
8. DELIVERY TIMEFRAMES ARE ESTIMATES ONLY
All delivery dates, estimates, schedules, and projected delivery windows provided by The Conex Guys LLC are estimates only and shall not be construed as guaranteed delivery dates.
The Conex Guys LLC shall not be liable for any delay arising from transportation scheduling, port delays, weather conditions, mechanical failures, accidents, government actions, labor shortages, litigation, customer disputes, or circumstances beyond the Company’s control.
9. ACCEPTANCE OF TERMS
Customer acknowledges that payment of any invoice, deposit, balance, or other amount automatically constitutes acceptance of these Terms and Conditions.
Customer further acknowledges receipt of these Terms and Conditions whether delivered by invoice, email, text message, electronic communication, website publication, or printed copy.
10. PAYMENT TERMS
Accepted forms of payment include:
- Cash
- Cashier’s Check
- Business Check
- Personal Check (subject to approval)
- Zelle®
Credit card payments are not accepted at this time unless specifically approved by The Conex Guys LLC.
If negotiated before the sale, Customer may pay a deposit prior to delivery and the remaining balance at delivery.
Unless otherwise agreed in writing, full payment is required before delivery scheduling.
11. CUSTOMER DISPUTES
Any dispute initiated by Customer including, but not limited to:
- Payment disputes
- Chargebacks
- Banking investigations
- Stop-payment requests
- Consumer complaints
- Regulatory complaints
shall immediately suspend all delivery obligations.
Delivery schedules shall stop and shall not resume until the dispute is fully resolved.
12. LITIGATION
If Customer files a lawsuit, arbitration demand, administrative complaint, regulatory complaint, or any legal action against The Conex Guys LLC, all delivery obligations shall immediately cease.
The transaction shall be suspended until final resolution of the matter.
Any delivery schedule shall automatically be extended by the duration of the dispute or litigation.
13. SITE ACCESS REQUIREMENTS
Customer is solely responsible for ensuring adequate site access for delivery equipment.
If delivery cannot be completed due to:
- Soft ground conditions
- Mud
- Snow
- Utility conflicts
- Overhead obstructions
- Insufficient roadway width
- Insufficient turning radius
- Unsafe site conditions
Customer shall be responsible for all additional delivery charges and the $2,500.00 dry-run fee.
14. LIMITATION OF LIABILITY
The Conex Guys LLC shall not be liable for delays, incidental damages, consequential damages, lost profits, lost business opportunities, or any damages arising from:
- Weather conditions
- Mechanical failures
- Port delays
- Transportation delays
- Traffic incidents
- Government actions
- Labor shortages
- Customer disputes
- Litigation
- Acts of God
- Circumstances beyond the Company’s control
15. GOVERNING LAW AND VENUE
These Terms and Conditions shall be governed by the laws of the State of Nevada.
Any dispute arising from these Terms and Conditions shall be brought exclusively in a court of competent jurisdiction within the State of Nevada.
CUSTOMER ACKNOWLEDGMENT
BY SUBMITTING PAYMENT, CUSTOMER ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, RECEIVED, AND AGREED TO THESE TERMS AND CONDITIONS IN THEIR ENTIRETY.
